TERMS OF USE
These Terms of Use apply to the user (referred herein as the ‘User’) of a service of Internet fax (referred herein as the ‘Service’) offered via the website freepopfax.com by POPESCO, company registered at the Versailles Trade Court under N° RCS 443 336 136 (herein referred as POPESCO).
User Responsibilities
Any person may use the Service. The Service must be used purely for legal purposes. The User recognizes that he/she has no right to use the Service to send illegal, harmful, defamatory, vulgar, obscene or reprehensible information in any respect. The User may not use the Service to send unsolicited advertisements, spam, or junk faxes. Should his faxing be reprehensible or legally subject to fines, the User acknowledges that he/she is solely responsible and agrees that he/she alone will bear all claims and legal or financial consequences thereof. Automated submission of faxes (including but not limited to information submitted using any bot, script, or macro) is not permitted. POPESCO does not exert any control of the content of information conveyed within its network or the network of his suppliers. In the case of POPESCO or its suppliers being held responsible due to a User’s failure to fulfill his lawful obligations or to comply with obligations as set forth in these Terms, the User undertakes to guarantee and indemnify POPESCO or his suppliers against any judgment pronounced upon them. This guarantee and indemnification will cover all court expenses, allowances paid and lawyer fees that POPESCO could be charged.
Guarantees exclusions
The User undertakes that he/she uses the Service in full understanding of it. The Service is delivered for free and with any particular guarantee to the User. POPESCO does not guarantee neither the quality of the results obtained through the Service, nor its precision, or the accuracy of the communication or transfer, nor the possible alteration of the data sent by the User nor the service availability.
Liability limitation
In no case shall POPESCO, its suppliers, employees or the subcontractors, be responsible for any indirect or direct damage or loss as a result of misuse or lack of experience of the User when working with the Service. The above limitation applies also to the goods or services bought or obtained, for the messages received or the transactions performed by using the Services or which arose following to an alteration of the User data transfer. The liability exclusion also applies, in addition to the above, and not exclusively, to the losses and/or any loss of profit, to data and other intangible assets, even though POPESCO could have been notified, at anytime, of such damage.
Complete Agreement
The Terms of Use define the relationship between POPESCO and the User. By using the Service the User accepts completely and without reservation the full terms set forth by this document. The Courts of Versailles (France) are the only competent jurisdiction for resolving all legal disputes related to the present terms, including, but not limited to, their validity, their interpretation, their execution and/or their cancellation and its consequences.
